Our neighborhood leaves food for homeless cats. One neighbor Katie, tames a few so she can have them spayed. Last Spring a beautiful, shy kitty disappeared for 2 months. June 17, 2020 she showed up pregnant, with a immobiletail and a softball sized wound on her spine. A hawk probably grabbed her. When she broke free her fur tore away, exposing raw skin. Lady is courageous. And smart. She went to Katie’s house for help.

We called vets in 3 counties for emergency surgery. No openings for 2 wks. Katie called Nicole Bawol at Erie PA Humane Society for a REFERRAL. Nicole appears on Erie News Now promoting adoptions. Nicole told Katie, “Bring the cat here. I’ll take care of her”.

Katie and her associate Jay drove 1 and a 1/2 hours to rush Lady to EHS. Nicole promised to give Lady back when her wound healed in 30 days. Katie and Jay donated $400. They promised a $5,000 donation later. No documents were signed.

Nicole told Katie and Jay, “We’ll take Lady to our veterinarian, nearby. (Pet Wellness Center). Jay told Nicole, “I can take her to the vet myself”. Nicole replied, “NO. That will be more expensive”.
Jay replied, “DON’T WORRY ABOUT THE EXPENSE”.

Nicole said, “Well...it’s easier on the cat if we take her. You can leave her in your carrier….it might affect her wound if we transfer her to our carrier”. Lady looked back at Katie as EHS staff took Lady away in her own carrier.

Nicole promised to return Lady when her wound healed in 30 days. Nicole told Katie & Jay, "I know you're good people. You can have Lady back". We all believed that Nicole would keep her promise.

Nicole updated Katie and Jay several times: Lady had an emergency C section. 3 kittens survived. Nicole emailed cute fotos of the kittens and additional updates. Then Nicole stopped communicating. For the next 7 weeks neighbors kept Lady and her kittens in our prayers. Many of us left messages for Nicole inquiring about Lady. We asked:
Please let us know if Lady is still alive.
If she escaped, let us know.
If you accidentally let someone adopt her, let us know.

Nicole Bawol did not return any of our calls.
She left us hanging in the agony of uncertainty for 7 weeks.

August 17, 2020 we wrote to Gery Neitupski, Esq. President, Erie PA Humane Society Board of Directors. Neitupski replied immediately with false information. He claimed to have a document authorizing EHS to keep Lady and never answer questions about her. If that’s true why did Nicole call with updates and email fotos of Lady’s kittens.

Jay did NOT sign any documents. His signature had to have been forged. That’s a Federal crime.

Katie called Neitupski. He said the document was attached to his letter. It wasn’t. He said he would re-send it. He hasn’t.

Neitupski told Katie, “You’re not getting Lady back”. Katie replied, “We’re contacting Atty General Josh Shapiro, Erie executive. Kathy Dahlkemper. and The Agriculture Dep’t”. Shapiro stands for Justice.

Katie asked Neitupski, “Can you at least tell me if Lady is alive”. Neitupski replied, “She’s alive and well and very happy”. He violated the document that blocks the release of information. Duplicitous. And how is he aware of Lady’s status?

Jay called Neitupski. He said, “I did NOT sign any documents. Someone forged my signature. That’s a Federal crime. If you don’t return Lady that’s theft of property. If you don’t return my carrier that’s theft of property”. Neitupski said, “You get your forgery experts, we’ll get ours. See you in court”.

Jay laughed. He’s not afraid of threats. His dad was a Dep’t of Justice lawyer. Neitupski hung up on Jay. BANG.

Note: An honorable man would admit to an error and arrange for Lady’s return. Mr. Neitupski expressed no concern for Lady. His primary focus: forgery and the threat of court action, not Lady’s well being.

We are all very concerned for Lady and other animals like her.
1. Nicole Baywol Leone or someone on her staff may have sold Lady to a research lab for experiment on her paralyzed tail. Researchers can experiment on torn ligaments, nerves and blood vessels in her tail, to study how neurons in her brain regulate the way her tail works or doesn’t work. The research can be applied to research that helps paralyzed human beings.
Modern surgeons can re-attach severed fingers hands on human beings. How do you think they perfect these procedures? Answer, they experiment on animals before they operate on human beings.

2. Lady’s fur could be sold for fur coats. Paul McCartney refused to perform in China after seeing an underground video of cats being skinned, their fur pelts were thrown onto 10 foot high piles. (See narrative below).

3. High schools and universities need animals for dissection in biology classes. We are concerned for Lady’s kittens and other stray animals. Anyone at Erie Humane Society could sell Lady’s kittens for dissection in Biology classes. Nicole told Katie that Lady’s kittens could die of sepsis, from Lady’s infected wound. Lady could have been sold for sepsis research.

Injured animals are valuable to researchers. Selling cat fur for fur coat designers is big business worldwide. Biology classes need animals for dissection. How do you suppose these agencies fill their needs for animals? They purchase them from human societies. (See narrative below). The Erie PA Humane Society can generate money by selling Lady and other animals for experimental research, fur coats designers or biology classes. Now you understand our concern for Lady.

We’re concerned about Lady’s 3 kittens. Nicole said they might die of sepsis from Lady’s infected wound. Nicole or anyone at Erie Humane Society could sell Lady’s kittens for dissection in Biology classes. Or sepsis research.

Katie told journalists, If I’d known that Nicole would not return Lady, I would never, not under any circumstances, have left her at the Erie Humane Society. Neighbors and I would have broadened the search for an emergency vet”.

Next Katie contacted Northwest PA Humane Society, Pet Wellness Centre where Nicole Bawol Leone sent Lady. Katie left messages for head veterinarian Dan Pierce, DVM, and Jennifer Weaver, DVM. They did not return her calls.

Katie and Jay’s veterinarian contacted The Pet Wellness Center. He was advised that Lady had been adopted. Erie Humane Society advised public officials that Lady was in foster care. These conflicting reports raise further concerns about Lady.

Neighbors retained a lawyer. However, a forensic psychiatrist advised, “Proceed with caution. If Lady is still alive, still with Erie Humane Society, the facility could do anything to Lady, just to get even”. We will not give up on protecting Lady.

Supplemental: First Hand Account

I loved animals all my life. As an adult I answered a TV ad to volunteer at a Humane Society. They needed dog walkers and cat cuddlers. I knew I might clean cages too. But there were terrible surprises to come. The first day of training the director took 8 of us on a tour of the facility. The first stop was a room filled with freezers. She opened one, it was packed with dead animals. Every freezer was. Dogs, cats, puppies, kittens. There was even a parrot in one freezer. All the animals had tags on their ears. Our job was to tag dead animals. Different animals in different stacks got different tags. After we tagged them we had to pack them in the freezers. The tags had specific information that showed where the animals would be sent. The animals were not waiting for cremation. There were live animals too. Their tags showed where they would be sent. I’ll let you figure out where the live and dead animals were sent. We all went through the first day but none of us went back. We wondered why the director showed us the freezers. To shock us? We kept our cool. The director told us we weren’t allowed to tell anyone about the freezer room due to confidentiality. That it was a crime to break confidentiality, that the police would charge us if we talked. Later I learned that confidentiality doesn’t apply if a crime is committed. I told this story because I know why these neighbors are concerned for Lady and her kittens.

Supplemental: Logical Conclusion

Many people ask, “Why would Erie Humane Society ignore a $5,000 donation? Nicole Bawol appears on Erie News Now asking people to adopt pets. The Erie Humane Society website asks for donations. Why not just give Lady back and collect $5,000? Nicole would have one less animal to adopt out. And EHS would have $5,000 more funding”. The only logical conclusion: EHS had to have known that a more lucrative payout lay somewhere down the line if they sold Lady for experiments on her broken tail.

Some people say, “But you can’t prove it”. There’s a saying in the law, Circumstantial evidence is as valid as concrete evidence, you just need more of it.

If the Erie Humane Society sold Lady for experimental research, and her kittens for dissection in biology classes, the concern is that other animals are sold for the same purpose. If so, who benefits from the profits? Are the sellers reporting the income to the IRS? The IRS knows how to prove income tax evasion.

Neighbors are contacting the US Department of Justice, Washington, DC and US Attorney Scott Brady, Erie.
